Higher Resources (HR)

Overview

Higher Resources (HR) respects the intellectual property rights of others and expects users of the Platform to do the same. This DMCA Policy is adopted pursuant to the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, which provides a safe harbor for online service providers that respond to notices of copyright infringement.

Reporting Copyright Infringement — DMCA Takedown Notice

If you believe that content available on the Platform infringes upon a copyright you own or control, you may submit a Notice of Claimed Infringement ("Takedown Notice") to our Designated Copyright Agent. Your Takedown Notice must include all of the following, as required by 17 U.S.C. § 512(c)(3):

• Identification of the copyrighted work you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
• Identification of the material that you claim is infringing, with enough detail for us to locate it on the Platform (e.g., URL, page title, description of location).
• Your contact information: your full legal name, mailing address, telephone number, and email address.
• A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Your physical or electronic signature.

IMPORTANT: Submitting a false Takedown Notice may expose you to civil liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

We recommend sending Takedown Notices by email for fastest processing. We will acknowledge receipt within 5 business days.

Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a Counter-Notification to our Designated Copyright Agent. Your Counter-Notification must include, as required by 17 U.S.C. § 512(g)(3):

• Your full legal name, mailing address, telephone number, and email address.
• Identification of the material that has been removed or disabled and the location at which it appeared before removal.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Higher Resources (HR) may be found), and that you will accept service of process from the person who provided the original Takedown Notice or their agent.
• Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, we will: forward a copy to the party who submitted the original Takedown Notice; inform the original complainant that we may restore the removed content in 10 business days; and restore the content within 10–14 business days if we do not receive notice that the original complainant has filed an action seeking a court order against the content provider.

Repeat Infringers

Higher Resources (HR) has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights. We may also limit access to the Platform for any user who infringes upon the intellectual property rights of others.

Modifications

We reserve the right to modify this DMCA Policy at any time. The current version will be posted on the Platform with the "Effective Date" noted above. Use of the Platform after any modification constitutes your acceptance of the revised policy.
